Funeral homes
Kansas requires a funeral establishment or branch license held by its funeral director in charge. Ask the funeral home to identify that person and its establishment license. The State Board of Mortuary Arts is the licensing regulator. [6]
At funeral providers covered by the federal Funeral Rule, you can obtain a General Price List to keep and choose the goods and services you want. The rule does not cover third-party casket sellers or cemeteries without an on-site funeral home. [18]

Kansas permits different funding methods for prearranged funerals, including insurance proceeds. For agreements governed by the deposit provisions, payments must be placed in qualifying insured financial institutions for the purchaser’s benefit, with statutory rules for account naming and deposit timing. Ask whether you are buying a deposited-funds agreement or an insurance-funded plan. [1][2]
For deposited funds, section 16-303 governs payment on demand and irrevocable elections. An irrevocable election can include specified merchandise, a monetary amount that is adjusted annually, and interest or earnings. Ask for the current indexed amount and the exact written terms. The section also preserves the ability to designate a different funeral home before death after written notice. [3]
